Space: Global Commons or Set of Distinct Domains?

Abstract

"Emerging governance questions surrounding the space economy rely on a shared understanding of the definition of the space domain. Chief among these definitions is that of the global commons. Considered by some to be analogous to the atmosphere and oceans, space and its resources could be considered the shared heritage of mankind. However, a competing perspective also exists that sees space as unclaimed territory. I make the case that space exists not as a uniform domain, but as a set of subdomains, each necessitating individual consideration. I further examine these domains using existing legal frameworks and analogous domains. Finally, I investigate the challenges and advantages of using Ostrom’s institutional analysis to score the domains and identify potential deficiencies."
