"The negotiation of 'use claims' in the establishment or maintenance of common property 'rights' has recently been the subject of much scholarly attention. As these studies have noted, the final product of these negotiations--a common property rights 'regime'--depends heavily on the political and institutional context in which they take place. More recent studies have also shown that different political contexts--bounded by national, subnational, tribal or other borders--can lead to different property rights regimes established in relation to a particular resource. While not often treated in terms of a common property right, clean air regulation treats this resource increasingly as common property. This paper will explore various property rights 'regimes' currently under negotiation at both the regional and national levels." |
